Terms of Service

1. Acceptance of Terms

By creating an account or using the TrueTales platform at truetales.us (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and TrueTales.

You must be at least 18 years old to create an account. By creating an account, you represent that you are 18 or older. Parents and guardians may create child profiles for minors under their supervision.

2. Description of the Service

TrueTales provides streaming access to a library of original patriotic audio stories for children, together with supplementary materials including discussion guides and educational resources. The Service is delivered via web browser at truetales.us.

We reserve the right to add, modify, or remove content from the library at any time. While we endeavor to maintain a stable and growing library, no specific story or feature is guaranteed to remain available indefinitely.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@truetales.us if you suspect unauthorized access to your account. TrueTales cannot be held liable for losses arising from unauthorized use of your account that results from your failure to keep credentials secure.

You may not share your account with others outside your immediate household. Multi-user household use is permitted for the subscriber and their children residing in the same household.

4. Subscription Plans and Billing

Available Plans

• Monthly Plan ($29/month): Billed monthly. Renews automatically each month until cancelled.
• Annual Plan ($249/year): Billed annually. Renews automatically each year until cancelled. Represents a savings of approximately 28% versus the monthly rate.
• Heritage Plan ($499 one-time): A single payment granting lifetime access to the TrueTales library as it exists and grows. No recurring charges.

Free Tier

A selection of stories may be made available at no charge. Free tier access is limited and may be modified at our discretion. TrueTales reserves the right to adjust which stories are included in the free tier.

Billing and Payment

All payments are processed by Stripe, Inc. By subscribing, you authorize TrueTales (through Stripe) to charge your payment method on the applicable billing cycle. Prices are in US dollars. We reserve the right to change subscription prices with at least 30 days advance notice to active subscribers.

Taxes

Prices shown are exclusive of applicable taxes. You are responsible for any applicable sales tax, use tax, or VAT based on your jurisdiction, which may be added to your invoice.

5. Cancellation and Refund Policy

Monthly and Annual Plans

You may cancel your subscription at any time through your account settings or via the Stripe billing portal. Upon cancellation, your subscription will remain active until the end of your current paid billing period. We do not provide pro-rated refunds for unused portions of a paid billing period, except as required by applicable law.

Heritage (Lifetime) Plan

Heritage Plan purchases may be refunded within 14 days of purchase if you have not accessed any premium content. After 14 days, Heritage Plan purchases are final and non-refundable. To request a refund within the 14-day window, contact us at support@truetales.us.

Free Trial

If TrueTales offers a free trial period, your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled beforehand. No charges are made during the free trial period.

6. License to Use Content

Subject to your compliance with these Terms and payment of applicable fees, TrueTales grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and stream TrueTales audio content for personal, non-commercial use within your household.

You may not:

• Download, copy, record, or redistribute any audio content.
• Use any content for commercial purposes, public performance, or broadcast.
• Reverse engineer, decompile, or circumvent any technical protection measures.
• Share your login credentials with persons outside your household.
• Use the Service in any way that infringes on the intellectual property rights of TrueTales or any third party.

All content on the TrueTales platform, including audio stories, scripts, artwork, descriptions, and supplementary materials, is the intellectual property of TrueTales or its licensors and is protected by copyright law.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any portion of the Service or its underlying systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Submit false, misleading, or fraudulent information during registration or checkout.
• Engage in any activity that imposes an unreasonable load on our infrastructure.

TrueTales reserves the right to suspend or terminate accounts that violate these conduct standards, with or without notice.

8. Parental Controls and Child Profiles

Parents and guardians are solely responsible for supervising their children's use of the Service. TrueTales provides optional parental control features (daily time limits, bedtime restrictions, PIN protection) as a convenience; however, we cannot guarantee that these controls will prevent all access. We recommend that parents periodically review their children's listening activity.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUETALES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law provisions. Any dispute arising from or related to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. You waive the right to participate in a class action lawsuit or class-wide arbitration.

12. Modifications to the Service and Terms

TrueTales reserves the right to modify these Terms at any time. We will provide at least 14 days advance notice of material changes to active subscribers via email. Your continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. TrueTales will not be liable to you for any modification, suspension, or discontinuation.

13. Termination

TrueTales may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to access the Service ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.
